Terms of Sale

These terms apply when you buy a report or a data subscription from The Hardest Market (hardestmarket.com), published by Makana Partners K.K. By completing a purchase you agree to them.
1. Who sells to you
Card payments in US dollars are processed by Polar Software, Inc. (polar.sh), which acts as merchant of record: it is the seller on your receipt and handles sales tax and VAT. Polar's own terms apply to the payment.
Payments in yen (card through Stripe, or bank transfer) are sold by Makana Partners K.K., Ocean Gate Minatomirai 8F, 3-7-1 Minatomirai, Nishi-ku, Yokohama, Kanagawa 220-0012, Japan, which issues a qualified invoice (registration T7020001128427). The required seller notice is on the Specified Commercial Transactions Act page.

3. Delivery
Everything is delivered digitally and immediately after payment: the report as a PDF download, and subscriptions as a licence key sent with the receipt, which opens the dashboard and data downloads. For bank transfer, we deliver once the payment is confirmed. If nothing arrives within one hour, write to editor@hardestmarket.com.
4. Licence
A subscription gives the number of users in your plan the right to use the data inside your organisation during the paid term. You may quote individual figures in your own reports and presentations with the credit "Source: The Hardest Market". You may not resell, republish or share the dataset or your licence key outside your organisation, or use it to build a competing product. The report is licensed to the buyer for internal use on the same terms.
5. Renewal and cancellation
Annual plans renew automatically at the end of each year at the price then shown, and we charge the payment method on file. You can cancel at any time before the renewal date from your receipt or by writing to us; access continues until the end of the paid year. Yen plans paid by bank transfer do not renew automatically; we send an invoice before the renewal date.
6. No refunds
These are digital products that are delivered as soon as payment is complete, so we do not offer refunds or accept returns once payment is complete, including for a change of mind, unused time on an annual plan, or cancellation part-way through a year. If a file or the dashboard does not work and we cannot fix it within a reasonable time, contact us and we will put it right, or refund at our discretion. For purchases through Polar, Polar may also refund at its own discretion within 60 days to prevent a card dispute, under its buyer terms. Nothing in this section limits rights you have under law that cannot be excluded.
7. The data
The data is compiled from public sources: companies' securities reports filed on EDINET, the Ministry of Health, Labour and Welfare's databases, and our own research. We check it carefully, but it is provided as is. Companies sometimes file figures that are wrong, and figures change. Do not rely on it as the only basis for a decision.
8. Liability
Except for wilful misconduct or gross negligence, Makana Partners K.K.'s total liability for any claim connected with a purchase is limited to the amount you paid in the twelve months before the claim. We are not liable for indirect or consequential loss.
9. Law and courts
These terms are governed by the laws of Japan. The Yokohama District Court has exclusive jurisdiction at first instance.
10. Changes and contact
